1. Introduction

1.1 Welcome to the BigxShow platform (“Site”, “App”). Please read these Terms of Service (“Agreement”) carefully before using the Site or opening a BigxShow account (“Account”) so that you are aware of your legal rights and obligations in relation to Shop Global (Thailand) co.,ltd (“BigxShow”, “we”, “us” or “our”).

1.2 Our services (“Services”) include:

• Website, mobile application
• Services provided by the Site and by the BigxShow client software made available through the website and mobile applications.
• Any information, information, links, features, data, text, images, photographs, graphics, music, sounds, video (including live streaming), messages, tags, content, programs, software, application services (including without limitation any mobile application services) or other materials made available through the Site or services related to the Site (“Content”).
• Any new features added to or augmenting the Service.

2. User account

2.1 In order to use certain Services, you must create a BigxShow account (“Account”).

2.2 When creating an account, you must:

• Provide accurate, complete and current information.
• Keep your passwords secure
• Be responsible for all activities that occur on your account.
• Notify BigxShow if you become aware of any unauthorized use of your account.
• You are entitled to become a member of His&Her and receive news from companies in the Sahapat Group automatically and agree to allow BigxShow and its affiliated companies to use your information for marketing communications.

2.3 Prohibited items are as follows:

• Using someone else's account
• Create accounts for commercial or illegal use.
• Use the service in a manner that violates any law, regulation or BigxShow policy.
• Use the Service to send spam, unauthorized advertising, promotional materials, or any solicitation.
• Use the Service to transmit any Content that is harmful, obscene, defamatory, threatening, harassing, tortious, defamatory, invasive of privacy, hateful, or discriminatory based on race, ethnicity, or any other reason.
• Use the Service to transmit content that contains viruses, Trojans, worms, deactivators, or other harmful programs or code.
• Use the Service to interfere with or disrupt the security of the Site or Service.
• Attempt to gain unauthorized access to the Site or Services, any part of the Site or Services, or any other computer systems or networks connected to the Site or Services.
• Interfere with or disrupt the operation of the Site or Services, or servers or networks connected to the Site or Services.

3. Limited usage rights

3.1 BigxShow grants you a limited and revocable license to access and use the Services in accordance with the Terms and Conditions of this Service. All intellectual property displayed on the Site, such as content, trademarks, service marks, brand names, logos, etc., are the property of BigxShow or third parties who hold the rights as stated on the Site. No right or license is granted to any person accessing the Site to use or copy the intellectual property. No person accessing the Site may claim any right, title or interest in this Site. By using or accessing the Services, by using or accessing the Services, you agree to comply with copyright, trademark, service mark, and other laws that protect the Services, the Site, and the content on the Site. You agree not to copy, distribute, republish, transmit, publicly display, publicly perform, modify, adapt, lease, sell, or create derivative works from any part of the Services, the Site, or the content on the Site. You agree not to mirror or frame any content on this Site on any other server or as part of any other website without our prior written consent. In addition, you agree not to use any robot, spider, or other automatic device or manual process to monitor or copy our Content without our prior written consent. (Such consent shall be deemed given for the standard search engine technologies used by Internet search websites to direct Internet users to this website.)

3.2 You may link to the Site from your website, provided that your website does not imply any endorsement by or association with BigxShow. You acknowledge that BigxShow may discontinue providing the Services, in whole or in part, at any time in its sole discretion.

4. Software

4.1 The software we make available to you as part of the Service is subject to the terms of these Terms of Service. BigxShow reserves all rights to the Software not expressly granted by BigxShow herein. Any third-party scripts or code linked to or referenced from the Service are licensed to you by the third-party scripts or code, not by BigxShow.

5. Account and security

5.1 Certain functions of our Services require the registration of an account by means of a unique user identification number ("User ID") and password, and by providing certain personal information. If a User ID is offensive or inappropriate, BigxShow has the right to suspend or terminate your account. You may use your account to access other products, websites or services that we provide access to, or that are linked or integrated with them. BigxShow does not review, and is not responsible for, third-party content, functionality, security, services, privacy policies or other practices of those products, websites or services. If you do so, those products', websites' or services' terms of service, including their respective privacy policies, if different from our Terms of Service and/or Privacy Policy, may apply to your use of those products, websites or services.

5.2 You agree to (a) keep your password confidential and use only your user ID and password when logging in; (b) ensure that you log out of your account at the end of each session on the Site; (c) immediately notify BigxShow of any unauthorized use of your account, user ID and/or password; and (d) ensure that your account information is accurate and up to date. You are fully responsible for all activities that occur under your user ID and account, even if you have not performed such activities or usage. BigxShow will not be liable for any loss or damage caused by any unauthorized use of your password or your failure to comply with this Section.

5.3 You agree that BigxShow may, for any reason and in its sole discretion and without liability to you or any third party, immediately terminate or suspend your account and user ID, modify, restrict, suspend or terminate your use of or access to the Site or any part thereof, remove or withdraw any content associated with your account or user ID from the Site, cancel or revoke any support provided to you, and/or cancel or suspend any transaction related to your account or user ID, temporarily or in more severe cases, permanently suspend any sales or refunds, and/or take any other measures that BigxShow deems appropriate, with or without notice within a reasonable period of time as required by applicable law, except in the case of serious or repeat offenses for which no prior notice is required, grounds for such action may include, but are not limited to, the following circumstances or suspicions that: (a) prolonged inactivity; Subject to BigxShow’s determination from time to time, (b) any violation of the letter or spirit of these Terms of Service; (c) any illegal, fraudulent, abusive, defamatory, threatening or intimidating behavior; (d) maintaining multiple user accounts for any unlawful reason; (e) purchasing goods from the Site for the purpose of resale; (f) purchasing goods from the same Seller or group of Sellers in an unusual or excessive manner; (g) misuse of discount vouchers (including, without limitation, selling discount vouchers to others or selling discount vouchers or credits at a price higher than their actual value or using discount vouchers in an unusual or excessive manner on the Site); or (h) behavior that is harmful to other Users, third parties or the business interests of BigxShow. Use of an Account for any illegal, fraudulent, abusive, defamatory, threatening or intimidating purpose may be reported to law enforcement agencies without notice to you. In the event of any legal dispute or legal action regarding your Account or use of the Services, for any reason, BigxShow may immediately terminate your Account by notifying you through the Site.

5.4 User may terminate his/her account if he/she notifies BigxShow in writing (including via email to Customer Service ) of his/her intention to do so. Notwithstanding such termination, User shall remain responsible and liable for any uncompleted transactions (whether initiated before or after such termination), product delivery, payment for products or the like, and User shall contact BigxShow after promptly and effectively completing and completing all uncompleted transactions in accordance with these Terms of Service. BigxShow shall not be liable and shall not be responsible for any damages incurred as a result of the action taken under this Section. User hereby waives any and all claims based on such action by BigxShow.

6. Violation of our Terms of Service

6.1 Violation of these Terms of Service, including any of BigxShow's terms, conditions and policies, may result in a number of actions, including but not limited to, any or all of the following:

• The account was deleted.
• Account privileges are limited
• The user account was suspended and later terminated.
• Criminally prosecuted
• Civil proceedings, including but not limited to claims for damages and/or interim relief before a court judgment or injunction.

7. Ordering and Payment

7.1 BigxShow may provide payment through various methods, including the methods set out below. BigxShow reserves the sole right to modify, suspend or cancel and/or impose any conditions, including but not limited to, minimum values, for any payment method.

• Credit Card: Credit card payments are processed through third-party payment gateways, and the types of credit cards accepted by these payment gateways may vary depending on your jurisdiction.
• QR PromptPay Bank Transfer: Buyers can pay via QR PromptPay bank transfer. The system will display a QR code image for buyers to save and scan to pay in their bank application.
• Payment via Mobile Banking: The buyer can make payment by transacting via the application of the supported bank that the buyer has registered to use financial services.
• E-Wallet: Buyers will be able to pay via E-Wallet. This service is provided by the e-wallet service providers that have collaborated with BigxShow. We will provide such services together with the terms, conditions, and policies of the service provided by the relevant e-wallet service providers. If the buyer has registered or opened an e-wallet account, it is considered that you have accepted the terms, conditions, and policies of the service provided by the relevant e-wallet service providers. You also consent to BigxShow to transfer your personal data in the care of BigxShow to the relevant e-wallet service providers for use in opening or registering an e-wallet account, managing, operating, administering, and providing other e-wallet services to you, including for any other purposes related to and in connection with providing such services.

7.2 The Buyer may change the preferred payment method only before making payment.

7.3 BigxShow is not responsible and shall not accept any liability for any loss or damage to Buyer resulting from incorrect shipping and/or payment information entered by Buyer or incorrect remittance of funds for the purchase of the Products. We reserve the right to verify that Buyer is properly authorized to use certain Payment Methods and may hold transactions until such authorization has been confirmed or cancel the relevant transaction if such confirmation is not made.
